Online Search Options

  • SearchIQS Portal — The clerk’s office maintains an online records search system through SearchIQS (Delaware County, NY). Guest searches are available at no cost; subscription plans provide expanded access to document images. The portal covers court records, land records, deeds, mortgages, and other instruments recorded with the clerk.
  • NYSCEF Case Search — Supreme Court civil cases filed electronically since May 23, 2018 can be searched through the NYSCEF Case Search system. Mandatory e-filing in Delaware County became effective November 20, 2019. Searches are available to the public without an account; court fees in e-filed cases must be paid online by credit card through the NYSCEF system.

Are Court Records Public in Delaware County?

New York’s Freedom of Information Law (FOIL), codified in Article 6 of the Public Officers Law (Sections 84–90), guarantees the public’s right to access records maintained by government agencies, including courts. Any information maintained, owned, filed, or created by a New York state agency is presumptively a public record unless a specific exemption applies.

Under FOIL and court-specific rules, the following categories of records may be withheld or restricted:

  • Records sealed by court order (including expunged criminal records)
  • Juvenile delinquency and Family Court proceedings involving minors

Per New York Public Officers Law § 87(2), agencies must disclose any reasonably segregable portion of a record after redacting exempt content. Written FOIL requests for court-related agency records can be submitted to the Committee on Open Government through the New York State Department of State.

Copy fees for certified court records are governed by CPLR § 8019. The clerk charges fees per page for reproductions; specific fee schedules are posted on the Delaware County Clerk’s fee page. All fees are payable in advance.

Delaware County Criminal Court Records

Court Jurisdiction

In New York State, felony criminal matters outside New York City are heard by the County Court, not the Supreme Court. The Delaware County Court at 3 Court Street handles felony prosecutions, indictments, and appeals from local criminal courts. Town and Village Justice Courts serve as courts of original instance for misdemeanors, vehicle and traffic violations, local ordinance violations, and certain lesser criminal offenses.

Requests may be submitted in person at the courthouse or by mail. For NYSCEF-filed cases, case documents are accessible through the NYSCEF Case Search portal. Note that sealed records, expunged cases, and grand jury materials are not available to the public.

Delaware County Civil Court Records

Supreme Court Civil Jurisdiction

Outside New York City, the Supreme Court handles major civil litigation — including contract disputes, personal injury actions, real property matters, mortgage foreclosures, and Article 78 proceedings — without any dollar threshold cap. Civil case records filed since May 2018 can be accessed online via the NYSCEF Case Search. Pre-electronic filings and hard copy records are accessible through the County Clerk’s office or via the SearchIQS portal. The default judgment filing fee in e-filed cases is $45.

Town and Village Courts — Small Claims and Civil Matters

For smaller monetary disputes, New York’s Town and Village Justice Courts handle small claims up to $3,000 and civil cases up to $3,000 in most jurisdictions, as well as landlord-tenant proceedings and evictions. Parties can file small claims in the court located in the town or village where the defendant resides or does business.

Land and Property Records

Land records — including deeds, mortgages, liens, lis pendens, and satisfactions — are recorded with the Delaware County Clerk and are searchable online through SearchIQS. All maps must be pre-filed with the Delaware County Real Property Tax Services Office before a deed referencing a map can be recorded.

Delaware County Family Court Records

Jurisdiction

The Delaware County Family Court has broad jurisdiction over matters involving children and families. It cannot grant a divorce — that authority rests with the Supreme Court — but it handles:

  • Child custody, visitation, and support
  • Paternity proceedings
  • Adoption and guardianship
  • Foster care approval and review
  • Juvenile delinquency and persons in need of supervision (PINS)
  • Child abuse and neglect proceedings
  • Family offense (domestic violence) petitions

Family Court records involving minors, child abuse and neglect proceedings, adoption files, and related matters are generally confidential and not available to the general public. Orders of protection and family offense proceedings may be accessible to the parties involved upon proper request.

Divorce Records

Divorce proceedings are initiated in the Supreme Court. The County Clerk maintains all Supreme Court filings, including divorce decrees and judgment rolls. Certified copies of divorce records carry a fee of $30.00 per record, consistent with the New York State vital records fee schedule. Older divorce records may be requested by mail from the County Clerk’s Office at P.O. Box 426, Delhi, NY 13753.

Marriage Records

Marriage licenses and records are issued by the city or town clerk in the municipality where the license was obtained, not by the Delaware County Clerk. Each municipality may charge varying fees for certified copies. The state records available through the New York State Department of Health include marriages from 1881 onward, though records prior to 1881 may only be available through local clerks. The certified copy fee from the state is $30.00 per record.

Birth and Death Records

Certified copies of birth and death records for events occurring in Delaware County are available through the New York State Department of Health Vital Records Section for births and deaths on record since 1881. The fee is $30.00 per certified copy for both birth and death certificates. Orders may be placed online through the state’s partner, VitalChek, or in person at the Vital Records office:

Persons 18 years of age or older may request certified copies of birth records. Access to certified death records may be restricted to immediate family members and those with a documented legal interest. In-person and online ordering options are both available; online orders through VitalChek include an additional processing fee.

Delaware County Probate Court Records

Surrogate’s Court Jurisdiction

All matters relating to the estates of deceased persons in Delaware County are under the jurisdiction of the Delaware County Surrogate’s Court. The Surrogate’s Court is governed primarily by the Surrogate Court Procedure Act (SCPA), the Estates, Powers and Trusts Law (EPTL), the Mental Hygiene Law (MHL), and the Uniform Rules for Surrogate’s Court (22 N.Y.C.R.R.). The court handles:

Searching Probate Records

Estate proceedings for Delaware County dating back to 1806 are on file and accessible to the public. The WebSurrogate system provides free online searching of estate files, associated documents, and historical records. Search options include party name, file number, old index, and will searches.

For in-person or mail searches, the court does not conduct searches over the phone. Written requests should be mailed to the Surrogate’s Court at 3 Court Street, Delhi, NY 13753. Search fees are:

  • Search covering records within the last 25 years: $30.00
  • Search covering records older than 25 years: $90.00

The court does not accept personal checks for mail requests; payment must be made by bank check or money order payable to Delaware County Surrogate’s Court. Cash and credit card payments (subject to a 2.99% service fee) are accepted in person only.

E-Filing in Surrogate’s Court

Mandatory e-filing applies to all new probate and administration proceedings commenced in the Delaware County Surrogate’s Court. Attorneys must file through the NYSCEF system.
