Confidentiality of Family Court Records

Under Family Court Act § 166, Family Court records are not open to indiscriminate public inspection. The court exercises discretion in determining access on a case-by-case basis. Divorce Records

Divorce proceedings are filed with the Essex County Supreme Court, not Family Court. Marriage Records

Death certificates are available only to the decedent’s spouse, parent, child, or sibling; individuals with a documented lawful right or medical need; or those holding a court order. The fee for both birth and death certificates is $30.00 per copy. Requests are made using the Birth Certificate Application (DOH-4380) and the Death Certificate Application (DOH-4376), submitted by mail to the Vital Records Certification Unit in Albany.

Essex County Probate Court Records

Probate matters in Essex County fall exclusively under the jurisdiction of the Essex County Surrogate’s Court, presided over by the Honorable Kristy L. Sprague. Chief Clerk Mirra Wheeler and Deputy Chief Clerk Ashley Engel staff the court’s clerk office. The Surrogate’s Court handles all proceedings related to the estates of deceased persons, including the probate of wills, administration of intestate estates, and disputes over estate management and asset distribution.
