Are Court Records Public in Jefferson County?

Under New York’s Judiciary Law, court records are presumptively open to the public. When a requester pays applicable fees, the court clerk must search files, papers, records, and dockets and either provide copies or confirm that the record is unavailable.   • Family Court records — Section 166 of the Family Court Act limits public inspection of Family Court proceedings.
  • Sealed criminal records — Under CPL § 160.50, criminal case records are sealed when a defendant is acquitted of all charges, charges are dismissed, or a juvenile offender case is transferred to Family Court.

  • Matrimonial records — Section 235 of the Domestic Relations Law restricts copying of matrimonial case records to the parties involved and their attorneys.
  • Confidential records — This category encompasses a defendant’s criminal history record (RAP sheet), alcohol or drug treatment records, sex crime case court records, and grand jury minutes.
  • Undercover agent testimony — Courts may restrict access to testimony by undercover agents and certain witnesses based on safety concerns.

New York’s Clean Slate Act, which took effect November 16, 2024, directs the Office of Court Administration to develop processes for automatically sealing eligible conviction records. OCA has up to three years to implement these processes. Until implementation is complete, criminal history records provided through the DCJS Records Review process will continue to include convictions that will eventually be sealed.

Jefferson County Criminal Court Records

Criminal jurisdiction in Jefferson County is divided among the County Court, Supreme Court, Watertown City Court, and the numerous town and village courts spread across the county.

County Court

The Jefferson County Court handles all felony prosecutions within the county and serves as an appellate court for appeals from lower courts. It also has limited civil jurisdiction over claims up to $25,000.

Watertown City Court adjudicates misdemeanors, lesser offenses, and conducts felony arraignments within city limits. It also handles civil suits up to $15,000 and small claims up to $5,000.

Town and Village Courts

More than twenty town and village courts operate throughout Jefferson County, each holding court on designated days. Criminal Certificate of Disposition

Sheriff’s Office Background Checks

The Jefferson County Sheriff’s Records Division provides walk-in background checks for $10.00. Applicants must present a valid photo ID or a notarized release signed by the person being checked. Only arrest records resulting in convictions are disclosed, and results may take several days. Report copies are available at $0.25 per page. Fingerprinting services are offered every Wednesday from 8:00 a.m. to 10:45 a.m. for a $5.00 fee.

New York State Criminal History (RAP Sheet)

For an official statewide criminal history record, applicants must go through the Division of Criminal Justice Services (DCJS):

  1. Schedule a fingerprinting appointment through the IdentoGo website or call (877) 472-6915.
  2. Bring a government-issued photo ID and $14.25 to the session.
  3. DCJS processes the request and mails the response within three to four weeks.

DCJS criminal history records are not public records and cannot be obtained through FOIL. Requesters can choose between an unsuppressed response (includes all records, even sealed ones) or a suppressed response (excludes sealed and suppressed information). Jefferson County Civil Court Records

Family Court records are restricted under Section 166 of the Family Court Act. Only eligible parties — typically litigants and their attorneys — may obtain copies. Requests may be submitted by mail, email, or phone.

Transcripts of Family Court hearings are available only to parties to the action, actively retained or assigned attorneys, or attorneys handling an appeal. Requesters must provide photo identification and submit the Request for Transcript Form. The form can be delivered to the Family Court directly, emailed, or submitted through the Electronic Document Delivery System (EDDS).

Marriage Records

Marriage records in Jefferson County are maintained at the city, town, and village level. Requesters should contact the local clerk where the marriage license was issued before contacting the County Clerk. The Jefferson County Clerk’s Office holds only an incomplete set of marriage records covering 1908 to 1935.

Divorce Records

Divorce (matrimonial) records are sealed under Section 235 of the Domestic Relations Law. Only the parties and their counsel may access them. Eligible requesters must complete the Divorce Request Form, include a money order payable to the Jefferson County Clerk, attach a copy of a valid photo ID with signature, and provide either a self-addressed stamped envelope or add $1.00 for postage. Types of Proceedings

The Surrogate’s Court handles three primary categories of estate proceedings:

  • Probate — When a person dies leaving a valid will, a probate proceeding distributes the estate according to the will’s terms.
