Are Court Records Public in Oneida County?
New York’s Judiciary Law § 255 mandates that court clerks search their files, papers, records, and dockets upon request and furnish copies to members of the public. This statute applies to the Oneida County Clerk, the Supreme and County Court Chief Clerk, and the clerks of each family, surrogate’s, city, town, and village court throughout the county. Additionally, the state’s Freedom of Information Law (FOIL), codified in Public Officers Law §§ 84–90, provides a separate right of access to records held by government agencies.
The County Clerk maintains records of all civil Supreme Court actions. With the exception of sealed and confidential filings, cases from 1992 to the present can be searched by the public through the IQS online portal or on in-office terminals. Criminal court files, however, are not available through the public records website due to the confidential information they contain. Criminal files that are not sealed may be viewed on a dedicated computer terminal inside the Clerk’s office.
Certain categories of records are restricted or sealed under New York law:
- Sealed criminal records — under CPL § 160.50, records are sealed when a criminal action terminates favorably for the accused.
- Active criminal investigations — files connected to ongoing law-enforcement investigations are exempt from public disclosure.
- Family Court records — proceedings involving children and families are generally confidential; access is limited to parties, their attorneys, and individuals with court orders.
- Juvenile records — delinquency proceedings are protected under the Family Court Act.
- Adoption records — sealed upon finalization.

Oneida County Criminal Court Records
Criminal matters in Oneida County are prosecuted across several court levels. The County Court holds exclusive trial jurisdiction over felonies. City courts in Rome, Oneida, and Sherrill handle misdemeanors and lesser offenses carrying maximum sentences of one year. The county’s numerous town and village courts process traffic violations, code infractions, and minor criminal offenses within their local boundaries. The Supreme Court may also hear certain felony cases.
Searching criminal case records. The WebCriminal portal provides free access to pending criminal cases in Oneida County’s Supreme and County courts, including upcoming court appearance dates. Users can search by defendant or corporation name, case number, or summons number. For city court criminal matters, WebCivil Local may cover some docket information.
Criminal files maintained by the County Clerk are not searchable through the online public records portal. To access unsealed criminal records, individuals must use the dedicated computer terminal located inside the Clerk’s office at 800 Park Avenue, Utica. Written criminal search requests can also be submitted to the Clerk’s office — provide the name and the timeframe to be searched. Processing may take up to 24 hours. Contact the office through its website for instructions. The search fee is $5.00 per name for every two-year period, with additional charges for any copies produced.
Statewide criminal history record search. The New York State Office of Court Administration (OCA) offers a Criminal History Record Search (CHRS) that covers conviction data from courts across the state. Each search costs $95.00 (nonrefundable) and requires account creation. Sealed records do not appear in CHRS results. Individuals seeking their own rap sheet may request it through the Division of Criminal Justice Services (DCJS), which requires fingerprint submission.
Arrest records and the Sheriff’s Office. Arrest and incident records are maintained by the arresting law-enforcement agency. The Oneida County Sheriff’s Office Records Unit handles requests for complaint reports, accident reports, and related paperwork.

The Records Unit accepts faxed requests (preferred), phone calls, and walk-in visits on a first-come, first-served basis. Reports typically take seven to ten days after an incident to reach the Records Unit for processing. One copy of “your” police report is provided at no cost; FOIL copies are $0.25 per page. Only the initial complaint report (CR-1) or accident report (MV-104a) is available to the general public. Investigative reports, arrest paperwork, and statements from parties other than the requester require a judge-signed subpoena.
The Sheriff’s Office also publishes an open arrest warrants page listing individuals with active court-issued warrants, including alleged offenses, age, and issuing court. For records held by the Rome Police Department, contact its records division directly.
Oneida County Civil Court Records

Confidentiality of Family Court records. Family Court records in New York are generally confidential and not open to the public. Access is restricted to the parties directly involved, their attorneys, and individuals holding a court order authorizing disclosure. The WebFamily portal provides limited case information for cases with upcoming court appearances; however, detailed documents and sealed matters are not viewable through this tool.
Divorce records. Divorce decrees (judgments of divorce) are filed with the Oneida County Clerk and maintained at the County Office Building. Because divorce proceedings are confidential, decrees are issued only to the parties involved and their attorneys. Eligible individuals can request a copy at:

A valid government-issued photo ID matching the name on the decree is required. Certified copies cost $5.00 per document for the first four pages, with $1.25 per additional page. Divorce certificates — shorter documents listing only the names and the filing date — are public records available from the Clerk’s office for $5.00 per copy.
Divorce certificates for divorces finalized on or after January 1, 1963 can also be ordered from the New York State Department of Health. Mail orders cost $30.00 per copy using the application form (DOH-4378), sent to the Vital Records Certification Unit, P.O. Box 2602, Albany, NY 12220-2602.
Marriage records. Marriage certificates are maintained by the city or town clerk where the marriage was recorded. Copies are also available from the New York State Department of Health for marriages dating back to 1880. The fee is $30.00 per copy by mail. Eligibility is limited to a spouse named on the certificate, a person with a documented need, or a party holding a court order.
Birth and death records. These vital records are issued by the clerk of the city or town where the birth or death occurred — not by the County Clerk. Each municipality maintains its own records, with availability varying by town. Birth certificates are restricted to the individual named on the certificate, their parents, spouse, or child, or a party with a court order. Death certificate access is limited to the spouse, parent, or child of the decedent, persons with a documented legal claim, or those holding a court order. The New York State Department of Health also maintains statewide vital records and accepts requests by mail or through VitalChek.

Searching probate records. The WebSurrogate portal is a free statewide service that allows the public to search estate proceedings, view docket information, and retrieve documents considered public record. Search options include name, file number, old index, will, and index book page. The system covers proceedings filed in Oneida County and every other county with a Surrogate’s Court.
Individuals may also visit the Surrogate’s Court Clerk’s office in person during business hours to review files, request copies, or conduct research. E-filing through NYSCEF is available for Surrogate’s Court matters.
Filing fees. Surrogate’s Court fees are governed by SCPA § 2402 and vary based on the gross value of the estate:

Selected additional fees include $150.00 for filing objections to a will (SCPA 1410), $20.00 for appointment of a guardian, $30.00 for a petition to compel an accounting, and $75.00 for a construction-of-will proceeding. Certified copies of Surrogate’s Court documents cost $6.00 per page. A search and certification costs $30.00 for records spanning fewer than 25 years and $90.00 for searches exceeding 25 years.
Adoption records. Adoptions may be filed in either the Surrogate’s Court or the Family Court. Upon finalization, adoption records involving minors are sealed and may not be disclosed without a court order. Sealed adoption files do not appear in public search results on WebSurrogate.
