Are Court Records Public in Queens County?
Queens County court records are presumptively open to public inspection under Section 255 of the New York Judiciary Law, which directs court clerks to make records available during regular business hours. Anyone who submits an appropriate request and pays applicable fees may obtain copies of most court records.

Searching Criminal Records Online
The eCourts WebCriminal portal provides case scheduling and status information for criminal matters with upcoming appearance dates. For a broader background search, the New York State Office of Court Administration operates the Criminal History Record Search (CHRS), which covers open, pending, and convicted criminal cases from all 62 counties. The fee is $95 per search, and results are based on an exact match of name and date of birth. Law Enforcement Records
The New York City Police Department maintains arrest records separately from court files. Queens County Civil Court Records
Civil litigation in Queens County is split between courts based on the claim amount. Supreme Court — Civil Term hears cases exceeding $25,000 and all matrimonial actions. Property Liens and Judgments

Confidentiality of Family Court Records
Family Court records in Queens County are confidential and restricted to persons directly involved in the proceedings — typically the parties, their attorneys, and authorized agencies. Members of the public cannot inspect these files without a court order. Adoption records are sealed upon the entry of the adoption decree and require a showing of good cause to unseal.
Certain Family Court case information can be searched online through the WebFamily portal, which allows lookups by file number, docket number, or attorney/law firm name.
Divorce Records
Divorce is a civil action filed in Supreme Court, not Family Court. Divorce decrees and related documents are maintained by the Queens County Clerk and are considered confidential under Domestic Relations Law § 235. Access is limited to the parties, the attorney of record, or a person bearing a notarized authorization from a party or their attorney.
To obtain a certified copy of a divorce decree from the Queens County Clerk, provide:

- The $8.00 certification fee (plus $0.65 per page for copies)
The New York State Department of Health also maintains divorce records statewide. Requests can be submitted by mail using the divorce record request form sent to the Vital Records Certification Unit, P.O. Box 2602, Albany, NY 12220-2602. Marriage records for domestic use cost $15 for the first copy and $10 for each additional copy. For foreign use, the first copy costs $35 and each additional copy costs $30.
Birth and Death Records
Birth and death certificates for Queens County residents are maintained by the New York City Department of Health and Mental Hygiene. These records are confidential under New York State Public Health Law, with access limited to authorized persons. Requests can be submitted through the department’s online service, by mail using the birth certificate application or death certificate application, or by scheduling an in-person appointment. The WebSurrogate portal is a free tool that allows anyone to search Surrogate’s Court files, retrieve documents, and view historical records that are considered public information. Requesting Records In Person or by Mail
Walk-in requests are handled at the Surrogate’s Court clerk’s office during business hours. Written requests should include the decedent’s full name, approximate date of death, file number if known, and applicable fees. Filing fees for probate and administration petitions are established by SCPA § 2402 and are based on the gross estate value:

Probate records, including wills that have been admitted to probate, are public and can be inspected by anyone.
