Are Court Records Public in Warren County?
Under New York Judiciary Law § 255, the County Clerk is obligated to search court records and furnish copies to any requester, or certify that no record can be found. Court records within Warren County are generally accessible to the public, though New York’s Freedom of Information Law (FOIL) does not specifically govern court records. Instead, public access to court case files is regulated by 22 NYCRR § 104.1, which defines court records broadly to include all documents in a case file along with administrative books, calendars, and statistical reports.
Several categories of records carry access restrictions or are sealed entirely:
- Sealed criminal records — Cases resulting in acquittal, dismissal, or certain adjudications (such as youthful offender determinations) are sealed under Criminal Procedure Law §§ 160.50, 160.55, and 160.59. New York’s Clean Slate Act, which took effect November 16, 2024, will eventually result in additional automatic sealing of eligible conviction records once the Office of Court Administration implements the required processes.
- Family Court records — Access is restricted under New York Family Court Act provisions. Individuals seeking these records must petition the court and demonstrate a valid reason for access. The court retains discretion to grant or deny the request.
- Matrimonial records — Divorce case files in Supreme Court are not open to general public inspection under Domestic Relations Law § 235.
- Adoption records — Permanently sealed under Domestic Relations Law § 114.
- Confidential materials — Grand jury minutes, probation reports, mental health evaluations, and pre-sentence investigation reports are not publicly available.
- Records sealed by court order — Any case file or portion of a file may be sealed when a judge finds sufficient cause.
The Warren County Clerk’s Office charges $0.65 per page for plain copies of public records, $1.25 per page for certified copies (with a $5.00 minimum), and $10.00 for exemplified copies. Requests made by mail are charged $1.30 per page. Historical documents predating 1950 carry an additional $10.00 handling fee.

Requesters must submit fingerprints in person at an approved location. As of February 2026, the processing fee is $47.50. Requests can be for either an unsuppressed rap sheet (including sealed and suppressed records) or a suppressed version (excluding sealed information). Processing takes approximately seven to ten business days. Individuals unable to pay may request a fee waiver application by emailing RecordReview@dcjs.ny.gov. Completed waiver packets, fingerprint cards, and supporting documentation should be mailed to the Records Review Unit, New York State Division of Criminal Justice Services, 80 South Swan Street, 5th Floor, Albany, NY 12210.
- Office of Court Administration (OCA) Criminal History Record Search — The OCA CHRS system provides name-based criminal history searches drawn from court disposition records statewide. The current fee for this search is $95.00.
Under N.Y. Comp. Codes R. & Regs. Tit. 9, § 6050.1, criminal history records maintained by DCJS are not considered public records and cannot be obtained through FOIL.
